150-Day License Term

Some licenses are issued with a 150-day term per Section 17520 of the Family Code or Section 11350.6 of the Welfare & Institutions Code (Support Obligations). The beginning and ending days of the 150-day term are contained in the comment. If the licensee fails to satisfy the provisions of the law, the license will expire at the end of the 150-day period and the license will be withheld/denied.

Conditional Suspension
per 10153.4 B&P Code

Salespeople can be issued a conditional license that has an 18-month term by qualifying with a course in Real Estate Principles and passing the real estate salesperson examination. Within 18 months after the license is issued, the licensee must submit evidence of completion of two additional college-level real estate courses. If the licensee fails to submit evidence to the Real Estate Commissioner of having successfully completed the educational requirements specified in Section 10153.4 of the Business & Professions Code, the license is suspended. The licensee may have the suspension removed if the course completion evidence is submitted prior to the four year license expiration date. If proper course completion evidence is not submitted before the end of the original four-year license term, the license cannot be renewed.

Disciplinary Action Comments

In reviewing a licensee’s information, please be aware that license discipline information may have been removed from a licensee’s record pursuant to Business & Professions Code Section 10083.2 (c). However, discipline information may be available from the California Department of Real Estate upon submittal of a request, or by calling the Department’s public information line at 1-877-373-4542.

These comments, in most cases, describe either a pending or final action taken against a licensee pursuant to the Business & Professions Code and/or the Administrative Procedure Act. Comments of this nature are designated by numbers that begin with either an 'H', generally indicating a formal administrative action or an 'R', generally indicating a recovery claim. An “Accusation” is the pleading which initiates a formal disciplinary proceeding against a real estate licensee. It sets forth and describes the particular facts that form the basis for the disciplinary action sought, and asks for a hearing and a decision imposing discipline. The person against whom the discipline is sought (“Respondent”) should be presumed “innocent” of the alleged wrongdoing until the disciplinary matter is concluded by an order following a hearing or a stipulation. The order or stipulation will then be the controlling document relative to the wrongdoing and discipline of the Respondent. Disciplinary Action Documents In reviewing a licensee’s information, please be aware that license discipline information may have been removed from a licensee’s record pursuant to Business & Professions Code Section 10083.2 (c). Pursuant to Section 10083.2(a) of the California Business & Professions Code, the department is required to provide on the Internet information regarding the status of every license issued by the department in accordance with the California Public Records Act and the Information Practices Act of 1977. The public information to be provided on the Internet includes information on suspensions and revocations of licenses issued by the department and accusations filed pursuant to the Administrative Procedure Act. Furthermore, the Real Estate Law does not have any provisions regarding a time limitation for providing such information.
